Thats all well and good, but if the seller indeed has the money order and even if he has not cashed it but refuses to ship the item or return the money order, it is considered "THEFT" under the eyes of the law and may even be considered as mail fraud. The seller should stop having a hissy fit, ship the item and then post his negative feedback. Then it ends there without anyone getting charged with a federal offence. But then again, some sellers and buyers are about as smart as a sack of hammers. FJS

Buyers have the right to not bid on any auction they choose not to bid on. Feedback is not a forum for free expression…it’s a way for buyers to alert potential buyers that sellers completed auctions as per the sellers’ terms of service. And a way of sellers to alert other sellers that buyers completed auctions as per the seller’s terms of service. It’s inappropriate to bid on an item without knowing shipping charges prior to auction’s close. It’s inappropriate to leave feedback prematurely. It’s WAY inappropriate to use feedback to complain about a seller’s terms of service. But you already knew all that…. What I’m interested in seeing is the exact text of the last paragraph of the message from eBay in response to your complaint. B

The seller will not say whether he has received and cashed the money order. The only thing he will say is that his records do not refect that he has received such a money order. Of course his records would not reflect having received and cashed such a money order if he did not want them to. This is the typical EBay seller who is mighty tricky. Such a seller will never give a straight answer but will couch his language in such terms as: My records do not reflect such and such. It is like dealing with Bill Clinton if you know what the meaning of "is" is? The way I see it is. This buyer should have complained when the total was given to them.(they sent payment after they knew the shipping cost) if they had a problem with the cost it should have been addressed before making payment. Wow, two lessons learned today: 1.) Don’t bid on an item without knowing what the shipping charges will be, unless you’re prepared to pay the unknown shipping charges. 2.) Don’t leave a quick negative for a stupid reason when you might have cause later to leave one for an important reason. It’s like shooting your only bullet into the air to scare off an assailant who’s armed with a knife. Save your bullet for when you need it. I hope you know how to rebuild carburetors.

did you know prior to bidding what the shipping charges were? If you did, you really agreed that they were okay with you when you bid. I was ripped off by a seller in California and I live in Canada. I bid and won the item and contacted the seller about the item. I sent him an International Postal Money Order in U.S. funds and awaited delivery of my item. I didn’t hear anything from the seller for over 3 weeks, so I emailed him to confirm if he received my payment. Average First Class Delivery via Registered Mail is about 5 – 10 Business Days from Canada to the U.S. which is the way I delivered my money to him. After about 2 months, I finally received an email that the item was on its way….. I never received the item. I contacted ebay and they couldn’t do much…so I went one step further….. Here’s what I did…..I contacted the United States Postal Service and filed a formal complaint with the Postmaster General and filed charges of Mail Fraud against this seller. I had to send a copy of all emails and I also sent a copy of my International Postal Money Order that I sent the person. I received confirmation from an investigator at USPS and they said they would look into this matter. USPS contacted the seller at his home and he was ordered to come in person to the USPS office to personally send me a refund, witnessed by the Post Office Investigator. This seller was charged with committing Mail Fraud, which I believe is a federal crime in your country. He also sent a letter with my refund claiming that he never received my money order….however, Canada Post showed that my money order was cashed and I also sent him the money order via registered mail (which has to be signed by the addressee to prove it was hand delivered). I believe the U.S. has laws similar in Canada that state it is a federal crime to knowingly advertise an item and fail to deliver it upon payment, unless the buyer is immediately notified that there will be a delay, or substitution, etc of the original item. I think it is important that all buyers and sellers be aware of their rights and privileges in the area of Mail Fraud…. The authorities consider Mail Fraud to be a crime and just because regular folks are buying and selling stuff to each other on ebay doesn’t make any of us above the law. Sellers on ebay are basically in the Mail Order business and there are certain rules and regulations you must follow to avoid be charged with Mail Fraud. just my 2 cents worth….
