What recourse? Seller sent wrong item, uggh.

Question:

As it stands, the seller already left a positive comment. The ball is in my court. I can neg him or he can figure out a way to make the goof he did right. How would you react if you were the seller and ticked off a buyer like

this? Okay, while you marinate in your power, don’t do anything until you get a reply to your email. If I was the seller, and your email  to me was showing the attitude you show here, I would: 1)  Apologize. 2)  Send you the proper CD (or a refund if you want) 3)  Pay for the return of the wrong CD 4)  Block you from my future auctions. Could we be talking about a bootleg CD. Easy enough to mix CD’s up if your copying a load of them. (so I’ve heard). It might explain a part of QwkKwoks post,though it’s not quite right. would have seen it was another CD and would not even did the auction as it was worded.

And if someone else has the wrong CD they would be emailing the seller I rest my case.

This happened to me recently.  Someone bought something for $10.00 Someone bought something for $150.00. The person that bought the $10.00 item wrote me and said that I had sent her the $150.00 item AND her $10.00 item. She lived in CALIFORNIA,the other item was going to MASSACHUSETTS.! I asked her if she could either send it back to me or rewrap it and send it to the New York address, and I would pay her immediately thru PayPal. She wanted to go the PO first to find out how much. I also got the contact info for the other buyer and told her what happened, but because I shipped so fast she hadn;t expected her package for another few days at least. I told her to let me know when it arrives and also if she evr bought something from me in the future she would have a $25.00 credit for my mix up. The cost was $14 or so, from the WEST and  I sent my wonderful honest buyer a payment   thru PayPal  of$25.00 and also some flowers where she worked. Needless to say I was very fortunate I had such an honest buyer!!! Glad that she liked what she bought and had been so pleased with it. Joe

this?     I would hope that the buyer would immediately email me and     tell me about my mistake, rather than assuming that I’m going     to cheat him.     Twice, I’ve mixed shipments up and people received the wrong     item.   As soon as ONE of them notified me, I issued refunds     to both….and asked them to mail the items to each other (or to     me).   They switched items, they were thrilled at getting their     item for only the cost of postage, and no harm was done.     It’s important to remember that the most distrustful people are     often those who should not be trusted themselves.   They figure     that everyone thinks like they do, and is out to cheat them.     All you need to do is write a simple email to the seller, telling     them something like "The CD case I received had a completely     different CD inside……how can this problem be fixed?" and     I’m sure the seller will come up with a completely satisfactory     solution.   After all, he left feedback for you first — meaning     that he’s not distrustful. LOL, Try reading ebays TOS someday, the thing they asked you to read when signing up for an account, and when bidding and what you should do in cases like this. LOL Contact the seller first! I push a LOT of items on ebay, and once in a very very great while, I might get a shipping label on the wrong box. it has happened twice in 3 years. The buyers contacted me and I took care of it. not a prob! I bet your seller will to, just dont neg the guy first, and dont send a snotty email to him either. I understand what you are saying, But to wrongfully neg someone is asking for it in return, we sow what we reap. Give the guy a chance to fix it. if he doesnt neg his ass off till your blue in the face. To automatically think this guy is going to screw you tells me I think I know why you have had probs with sellers in the past. Of I am jumping the gun on that statement the way you are on that guy. Chill for a bit. I have had well over 10,000 transactions on ebay and maybe only 20 bad ones. Communication and attitude means the world as to what you will get when dealing online.

but i don’t believe we are talking about a pirate cd here.  more than likely the seller will find the cd in the other (the cd sent) case or if sold, that person will have the matching incorrect cd.  it can be worked out *if* this buyer is patient. but jumping straight to a neg will make nobody happy. robert

I am assuming the seller had a bunch of CDs he bought in some fleamarket lot sale and just did not bother to look to see if the actual CD was in there, let alone listen to it. If that is the case, then he might not have the CD lying around. It would take some big garbanzos of me to outright  accuse him of sending the wrong CD if I was trying to hedge a guess that he might not have doublechecked the CD case contents. It is plausible he lent the CD out and did not recheck to see if the correct one was in it too. Yeah, some of you think this is small potatoes. In the scheme of things, yes, but Ebayers need to be better than the average Joe to make Ebay appealing and keep sellers and buyers coming. Just ask yourself if you sent something to a winning bidder w/o verifying the correct item sent how you would view your actions. Would you be embarassed ? The buyer emailed, I immediately paypal’d him a full refund including shipping and told him to keep what he had (didn’t have much resale value as it was anyway). He left a nice positive about immediate response to problem and refund.

Similar deal here. Sent the wrong item, refunded the money once I was told about it and still sent the right CD out. No biggy! it happens!

I emailed the seller a quick note that they sent a mismatched CD with the case.   BTW, there is nothing Ebay can do unless multiple complaints come in about the same issue.  With CD piracy, everybody knows how easy it is for a buyer to order a CD, say it didn’t arrive, and request a SECOND copy for their friends.  This is how people will judge you

You are jumping the gun here…  you don’t know exactly WHY the wrong cd was shipped.. For all you know, this person’s kid could have played the CD and put the wrong one back, etc.. any number of things could have happened. You also stated that ebayers need to be better than the average Joe.. you are wrong.  eBay is *FOR* the average Joe to sell thing.  It just so happens to be a good market for some business owners as well.  *I* have to be better than the average Joe as I am a business… but if I were just selling my left over stuff, I WOULD BE the average Joe… Give the guy a chance to fix the problem before getting all wound up about it.  Think about it.. if you buy an item at a local store, and it doesn’t work, do you call the better business bureau and complain that the store is committing fraud?  Or do you simply go to the store, explain the situation, and get a new one?  I suspect the latter…  so, why, then, would you burst at the seams with this guy.. just because he’s online? Please.. let me know your auction ID… I’d really like to block you from any of my auctions, because, God forbid, I make a mistake like so many other humans do from time to time.

Personally?  I’d respond to your neg by noting that you didn’t bother to let me try to resolve the problem, I’d block you from further bidding on my auctions, and I’d write you off as yet another of the childish, impatient, nut cases that seem to infest eBay these days. —   Ty Who is mostly just a slightly skewed Donna Reed This address is white-listed.  Mail sent to it may ping back to the sender.

Pretty easily, and I really don’t think it’s worth the anxiety you’re expending on it; I also think you’re a bit overengaged for planning for disaster.  It’s a simple error.  Politely mention it to the seller and ask for either a full refund or the proper CD.   It doesn’t matter where you’re buying, mistakes sometimes happen.  I buy a ton of retail stuff mail order, and sometimes the wrong thing is in the package.  Then you inform the merchant and they fix it.  That’s all it takes :-) . If I’d made a mistake I’d refund your money.  If you expressed the same attitude in your email as you were in your postings here, I’d also immediately add you to my blocked bidder list. You seem to be missing the point a lot here.  Your first assumption, stated in your original posting, was "I feel like I will be screwed here as the seller can deny they made a mistake. What should Ebay do?"  Your taking a situation where the seller could have made a simple mistake, and assuming he’s a cheat, and trying to figure out a way to get eBay involved before you ever give the person a chance to make it right.  You state "I am assuming the seller had a bunch of CDs he bought in some fleamarket lot sale and just did not bother to look to see if the actual CD was in there, let alone listen to it."  Why would you assume that, when he could have just as easily listened to the CDs, and mistakenly put the wrong CD back in the case? Mistakes happen, and problems arise.  Reasonable people try to resolve those problems amicably.  You may end up in a situation where the seller refuses to send the correct CD or a refund, and if that happens you can worry about how to deal with the matter, when he’s already demonstrated that he’s behaving unethically.  When you assume the worst about people and treat them accordingly, you often end up giving people a rationale for thinking "well it could be my mistake, but after the way he acted there’s no way I’m going to refund his money."  Give the seller a chance to behave ethically before you decide he’s a crook. Recently we did something similar, sent a used item and one of the CDs was not what I thought it was. it was a mistake, give him a chance to fix it…. and put the "attitude" away until you find out he won’t. robert
