eBay suspend my account just because i'm selling one legit DVD in Hong Kong?

Question:

- Hide quoted text — Show quoted text – Recently, i received warning from safeharbor regarding one of my auction violate VERO policy. "Crossroads – Britney Spears DVD" The DVD in question is distributed by Universe Laser & Video (http://www.u333.com) and the film distributor is Deion International Film Limited. The item was purchase from HMV here and is a legit product. I’m in Hong Kong and selling this item in Hong Kong through eBay International (http://www.ebay.com). That’s eBay US, and that may well be the factor here, since you could be selling it to US buyers and not just those in the regions where such importation would be legal. What does it have to do with Paramount Picture? In many countries, says, Hong Kong for example, parallel import is perfectly ok as long as an  item is not a pirated copy. Video shops as well as HMV, Tower Records here selling region 1 dvd imported from US, region 2 dvd imported from japan and UK, region 3 dvd and region 4 dvd from australia. some other countries in the world also allow parallel import. the bottom line is this DVD DOES NOT BELONG TO PARAMOUNT PICTURE (AT LEAST NOT IN HONG KONG). i am selling this DVD in HOng KOng to buyers in Hong Kong, buyers in Macau and buyers in regions like Hong Kong that allow parallel imports THROUGH eBay International! I believe there’s an appeals for a VeRO violation; give it a try.  Was your auction limited to buyers from the countries where this is legal?  If not, that may be worth doing as well.

i stated in my auction.. "will ship world-wide". i did send e-mails to ebay as well as to that person who on behalf of i asked them to check with Universe Laser & Video (http://www.u333.com) , check with "Paramount Picture" distribution unit (if any), check with Intellectual Property Department Hong Kong (http://info.gov.hk/ipd/eng/index.htm) Universe Laser & Video has the DVD/VCD copyright of this title in HK & Macau not Paramount Picture!

Response:

good seller wrote Recently, i received warning from safeharbor regarding one of my auction violate VERO policy.

And you got suspended right away? Usually, eBay will only suspend you for this if you keep selling the same item after you have been warned. If you only received one VeRO warning, you can appeal it. If you received a VeRO warning and ignored it, continuing to sell the same item, you will likely not be able to use eBay again. eBay owns the playground so the game is played acording to eBay’s rules. If you don’t play by their rules, they can kick you out.

Response:

so why do i get suspended?

Because Paramount Pictures is a BIG company with lots of lawyers who can make lots of trouble for eBay who makes the rules for using eBay. If I were you I’d put an ad in the local classified ads and forget about selling this DVD on eBay. BobR

There are only a handful of Legit Chinese DVD’s. And those dvd’s are made for China/Taiwan regions. And also, they are usually not "ALL region" or REgion 0. Universe Laser is also a known bootlegging distributor. IF you sell it on Ebay, you potentially sell it to those who do not live in China/Taiwan where its legal there to own. Crossroads isn’t even on DVD in America yet, so how can "China" get a dvd out so soon? Easily, they are made from theater recordsin, hence they are unauthorized bootlegs. Paramount Pictures has every right to end auctions and get users suspended if they continue to sell pirated goods. Since they hold the distribution rights to Crossroads WORLDWIDE, how can Universe Laser distribute it? I list my auction very clear that the item is a legit product and a very clear picture is posted together and i even quoted the IFPI SID code marked on disc so why do i get suspended?

Can you guarantee that a NON- hong kong person will bid and win it? no.

beware of what you said, you might get sued from Universe. They are a prettly well-known distributor in Hong Kong. I bet you never been to Hong Kong and Taiwan. We have lots of legit DVDs here. huh? check yourself. so how can "China" get a dvd out so soon? Easily, they are made from theater recordsin, hence they are unauthorized bootlegs.

IFPI SID code marked on disc. DTS sound. Digital remastered picture (made from Original Master Disc). well-known distributor. avialalbe in well-known internationl record store like HMV. you are just a typical american fool. Paramount Pictures has every right to end auctions and get users suspended if they continue to sell pirated goods. Since they hold the distribution rights to Crossroads WORLDWIDE, how can Universe Laser distribute it?

Paramount Picture doesn’t hold the distributor rights WORLDWIDE although many other titles yes. The production company, Zxxxx authorized Universe Hong Kong to distribute this title in Hong Kong/Macau. This title has nothing to do with Paramount Picture. – Hide quoted text — Show quoted text – In many countries, says, Hong Kong for example, parallel import is perfectly ok as long as an  item is not a pirated copy. Then restrict your sales to HK and Macau. If you ship where Paramount has rights, they seem to take a dim view of it. I think you’re proceeding properly here in checking things out further with Paramount, but I also think that Paramount’s theory is that if you’re selling where they’ve got the rights–the "shipping worldwide" condition–they’re going to ensure eBay doesn’t let you do it.
