Question:
Oh, forgot to mention. UseNet "spam" IS against eBay’s TOS: http://pages.ebay.com/help/usenet_policy.html
Yeah – blah – blah – blah – blah – blah – blah! I read all that and actually believed it. Hah! Ebay has the policy posted there but doesn’t enforce it. Even when the auctioneer admits it but doesn’t care. Even when numerous people have complained. Read teh emails I originally posted – it’s all there. The original post with headers of about the 20th spam I complained about, my ~20th complaint to ebay with a pointed request for an answer as to why nothing was happening, and their telling me to kiss-off. This seller simply makes too much money for them. A previous person in this thread I think shed some light in implying it is a lot a matter of how people might be feeling on any given day. I think that is a factor but mostly it is an unknown equation that has variables of: a) how many people complained (i.e., how much ill-will is being generated), b) how much money the seller generates, c) how big an *ssh*le (or possibly how lazy) the ebay feels like being that day. I think as a company, ebay is about as bad as Microsoft (or Enron for that matter) and is devoid of ethics. So, again, feeeellll freeeeeee to spam usenet all you want. ebay tells me they can’t really do anything about it. They are too unethical, stupid, and lazy.

Look at the criterion you just posted above. b) is prolly most important, unfortunately. If your don’t do ALOT of b) but get alot of a) or run into just one instance of c), you’re prolly busted. Mac (doogle)

I know for a fact that folks have been suspended from eBay for UseNet complaints, at least temporarily. Depends on – how many complain – mood of tech – what the user might say back to tech to further piss tech off when they get a "warning" – maybe other stuff
Yea, you forgot phase of the moon/planets, which is why I keep my astronomy software current.

snip Sorry, Surfer, you’re barking up the wrong tree and wasting eBay’s time with your bs complaints. eBay cannot control what their Sellers do off-eBay any more than the local grocery can control who I throw their tomatos at.

Headers won’t prove a thing if the poster uses a web based news service that they can join anonymously (i.e. lie about who they are). Dan — http://www.Auction-Sentry.com
– Hide quoted text — Show quoted text – In that case, all one would have to do to get someone in trouble and eventually suspended is to spam newsgroups with their auctions posing as them… You see the problem? How does eBay "prove" that it is the seller that posted? Unscrupulous sellers could use this as a way to thin out their competitors. Dan Most of the ones we seen most probs with come back and admit/debate it, often using their real emails. I don’t think eBay does any more than email a caution the first go round anyway, time to prove with headers and whatnot which way the wind really blows if it gets more hot and heavy with complaints. But yeah, it could happen, but actual asshole would be taking a risk too. eBay *does* have some pretty sharp sysops if it came to that. They have to be sharp, to make the cobbled together monstrosity that has evolved there work at all. Amazing how few glitches there actually are, I’ve always thought. Oh, forgot to mention. UseNet "spam" IS against eBay’s TOS: http://pages.ebay.com/help/usenet_policy.html UseNet Policy eBay users may not post on Usenet groups (Internet newsgroups) to advertise eBay or an eBay listing that is inappropriate or violates the Usenet board policy. If Usenet abuse is reported to eBay, we may among other remedies) remove the listing, issue a warning, temporarily suspend or indefinitely suspend the offender’s eBay account. We have no tolerance for UseNet abuse and will take action as appropriate. Please note that we can only take action in cases where it is clear that an eBay member has posted to the Usenet inappropriately. Usenet abuse should also be reported to your ISP (Internet Service Provider) and the email provider of the person posting on the Usenet. Both of these organizations are in a much better position to prevent properly report perceived violations. — Mac McDougald Doogle Digital – www.doogle.com

For those of you who have been thinking about SPAMMING your auctions into Usenet Newsgroups, GO AHEAD! Ebay won’t do a g*dd*mn thing about it and will also deflect any/all complaints from Usenet users about your SPAM. It’s open season! SPAM! SPAM! SPAM! SPAM! SPAM! SPAM! SPAM! SPAM! SPAM! Wonderful SPAM, Wonderful SPAAAMMMM! Below, in reverse-order, is the dialogue to prove it. Hi XXXXX – Let’s be real clear about this: EBAY chooses not to stop members from inapropriately posting to certain newsgroups because it is in EBAY’s interest to have them posted as far and wide as possible. And my efforts have not been about, "keeping eBay a safe and fair place to trade!" My efforts have been about trying to keep the newsgroups I frequent from becoming overrun with SPAM and irrelevant posts. EBAY has no interest in this, of course, because it is COUNTER to your interests. If you chose to do so, EBAY could cause this activity to cease IMMEDIATELY. My opinion of and attitude towards ebay has changed radically at this point and my course of action is going to change as well. YYYYY
Hi YYYYY, Thank you for writing to eBay. I am sorry to hear about this situation, and understand your frustration and concern over the issue. Unfortunately, we at eBay are not able to stop our members from posting their auctions in newsgroups. We do ask that our members are aware of the newsgroup charters before they post, but other than that, we are unable to control what they do outside of their eBay transactions. We have taken as much action against this member as our policy allows. We do appreciate you for taking the time to write and I appreciate your continued help in keeping eBay a safe and fair place to trade! Have a great weekend! Either you are: a) doing NOTHING, or b) THIS USER IS IGNORING YOU. You should at least have the decency to tell me which of these situations is in effect. This user continues to SPAM. They claim to post these as SALES – they are AUCTIONS. They also offer the same products for sale outside of your venue. Isn’t this yet another violation of ebay TOS? These are AUCTIONS – SEE THE TITLE OF THE SPAM. But even if you want to call these AUCTIONS sales, THEY ARE NOT IN HOUSTON. This is a violation of usenet policy.
